Transfer process

Title I Transfers

  1. Notify us that you intend to have a gun transferred to us from another FFL dealer and provide us with your contact information.

 2. Give our information to the FFL you are purchasing from & have them contact us. When they do, we will obtain a copy of the dealers FFL and provide them with our FFL in order to ship the firearm.

 3. The customer will need to work out payment details with the dealer they are purchasing the firearm from. Magnolia Armament will not take payments for a purchase for another dealer. It is the sole responsibility of the customer and the dealer you are purchasing from to make payment and shipping arrangements.

4.  Magnolia Armament will notify you when the firearm is ready to be picked up.

  • Please allow 24-48 hours from the time of arrival for the firearm to be ready for pick up!
  • Any Title I transfer firearms left unspoken for by transferee for more than 14 days from the date Magnolia Armament notifies the transferee that the firearm is ready for pickup will incur a $1/day storage fee.
  • Customer agrees that any firearm or other property received by Magnolia Armament on customer’s behalf will be considered abandoned by customer  if not picked up within 180 days after delivery to Magnolia Armament and will be sold to cover receiving and storage fees incurred by Magnolia Armament.

5. You will then fill out an ATF form 4473 and complete a background check.

  • Magnolia Armament WILL NOT TRANSFER a firearm without a PROCEED status. It is the SOLE RESPONSIBILTY of the customer to be aware of this. Customer is responsible for any fees or inconveniences due to failure to pass a background check.

6. Once the background check is completed, you will pay the appropriate transfer fee from the list above.

Title II Transfers

Title II transfers are more complex and can have some variations, but here’s the general process. Currently, the typical timeline for Title II transfers is 9 to 13 months, but this has gotten somewhat better with the ATF opening up the electronic form 5320.4, aka ‘Form 4’.

  1. Unless the item is a silencer, contact us for prior approval to have the items shipped to us.
  2. Give our information to the FFL/SOT you are purchasing from & have them contact us. When they do, we will obtain a copy of the dealers FFL/SOT and provide them with our FFL/SOT in order to begin the process to ship the firearm. The shipping dealer will complete an ATF form 5320.3 for ATF approval to ship the item to us, and after approval will ship the item to us. (Electronic version currently takes a couple of days, paper version currently takes 3-5 weeks.)
  3. Here again, the customer will need to work out payment details with the dealer they are purchasing the firearm from. Magnolia Armament will not take payments for a purchase for another dealer. It is the sole responsibility of the customer and the dealer you are purchasing from to make payment and shipping arrangements.
  4. Magnolia Armament will notify you when we have received the item and are ready to proceed to the next step.
  5. Magnolia Armament will provide the customer with the necessary paperwork to fill out for the ATF Form 4. This is where there can be variations, but generally speaking this will be an ATF Form 5320.23, or Responsible Persons Questionnaire. For this form you will be required to submit the completed form to us, a copy of the form to your CLEO(Chief Law Enforcement Officer), a set of fingerprints electronically or printed on an FBI Form FD-258, and a passport photo. If filing electronically, we’ll take the photo and handle that part for you.
  6. Once we have all the proper paperwork from step 5, we will fill out ATF Form 4 for the transfer, and this is where the waiting begins. This is the step where the 9-13 month wait occurs. (Current ATF processing times can be found here.)
    • If filing electronically, we’ll collect the 200$ fee from you and pay the tax when submitting the Form 4. If paper, you will include a check with the packet we send to the ATF.
  7. Once we’ve received your tax stamp(What Form 4 applies for), we’ll notify you that the item is ready to be picked up.
    • Any Title II transfer items left unspoken for by transferee for more than 10 days from the date Magnolia Armament notifies the transferee that the item is ready for pickup will incur a $5/day storage fee. This fee is capped at 500$.
  8. When you come to pick up the item, you’ll complete an ATF Form 4473, but no background check is required at this point as the background check was part of the Form 4 process and has already been completed.
  9. You’ll pay the appropriate fees as agreed upon previously when you contacted us to start the transfer process.
  10. Go to the range and enjoy!

Again, this is a general overview of the Title II transfer process.
